Environmental Site Assessments (ESAs) are used for a property owner to be eligible for the CERCLA “Innocent Landowner Defense”. This law was passed to allow the owner of contaminated property to defend against liability for hazardous substances that may have been put on the property by a third party or that may have migrated to the property from an off-site source. Failure to conduct an ESA prior to the purchase of a commercial property may leave the buyer liable for all costs associated with future cleanup, should contamination be found. Cleanup of contaminated soil or groundwater can be very costly and in some cases may exceed the value of the property. Therefore, it is a worthwhile investment to protect your assets or your financial future by conducting an ESA before purchase.
The reliability of any ESA ultimately depends on the qualification, experience, and thoroughness of the individual conducting the ESA within the scope and limitations of EPA’s 40 CFR 312 and ASTM Standards.
